Pebble Partnership Lawsuit Against EPA Thrown Out

The Pebble Partnership had asked a federal judge to consider blocking the Environmental Protection Agency from using an unusual move to prevent the partnership from moving forward with permitting.

 

Mike Heatwole with the Partnership said obviously they are disappointed with the ruling to dismiss the case against the EPA and their next steps are undetermined.

 

Heatwole: “The question of whether or not to appeal is something we’re taking a look at with our legal team right now and we obviously viewed our case as having an impact on us already which is what we argued in front of the judge, he obviously saw that differently and said we need to wait for final action by the agency. And so we’re sorting out whether or not we think there are grounds for appeal and we’ll make a decision on that some time in the near future, so no final determination there as of yet.”

Heatwole said they are still pressing for another partner to move the project forward which moves with an air of uncertainty due to the EPA’s actions so far.

 

In a different ongoing case against the EPA where the Partnership alleged the EPA was violating of the Federal Advisory Committee Act, a judge viewed  the case strong enough to tell the EPA they must wait until after January of 2015 to make a next step so that there is time to review all the details.
